WASHINGTON / NEW YORK -UNS : A major political and legal confrontation has erupted in the United States after President Donald Trump categorically ruled out any possibility of Israeli Prime Minister Benjamin Netanyahu being arrested during his planned visit to New York for the United Nations General Assembly (UNGA) in September.
The dispute has placed the White House and New York City’s leadership on opposing sides over the implications of the International Criminal Court (ICC) arrest warrant issued against Netanyahu, raising broader questions about diplomatic immunity, federal authority, and the enforcement of international law within the United States.
In a strongly worded statement issued Monday evening, President Trump declared that the Israeli premier would remain fully protected while on American soil.
> “Benjamin Netanyahu will not, under any circumstances or in any way, be arrested while in the United States of America,” Trump said.
The statement came in response to remarks by New York City Mayor Zahran Mamdani, who confirmed that his administration is consulting legal experts to determine whether any action could be taken if Netanyahu visits New York.
Appearing on The New York Times’ The Interview podcast, Mamdani said:
> “I think Prime Minister Netanyahu belongs in The Hague. He is a war criminal who has been indicted by the International Criminal Court.”
He added that many people share that assessment because of Netanyahu’s conduct during the Gaza conflict.
At the same time, Mamdani acknowledged that the legal authority of a New York City mayor to direct police action against a visiting foreign leader remains uncertain.
> “Whatever the law in New York allows me to do, that’s what we will do. We will not make our own laws for this purpose,” he said, adding that his office remains in “active dialogue” with municipal legal advisers.
Netanyahu Rejects ICC Claims
Prime Minister Netanyahu dismissed the mayor’s comments, accusing him of pursuing political grandstanding instead of addressing New York City’s domestic challenges.
> “He should focus on repairing the damage he has done to the city,” Netanyahu said.
The Israeli leader has consistently rejected the ICC proceedings, maintaining that the court lacks jurisdiction over Israel and describing the case as politically motivated.
Trump Links Support to Iran Policy
President Trump also defended Netanyahu by portraying him as a key partner in confronting Iran and regional security threats.
Writing on Truth Social, Trump argued that those responsible for Iran’s actions—not America’s allies—should face accountability.
> “The only people who should be arrested are those who led Iran into this unprecedented spiral of death and destruction,” Trump wrote.
He also criticized previous US administrations for what he described as years of inadequate policies toward Tehran.
UN Visit Set to Draw Global Attention
Netanyahu is expected to travel to New York in September to address the United Nations General Assembly and meet President Trump to discuss Iran, Gaza, regional security, and broader Middle East developments.
However, the diplomatic visit has already become the center of an intense legal and political debate.
Legal analysts note that enforcement of ICC warrants in the United States involves complex constitutional and diplomatic considerations, including the respective powers of federal and local authorities, international treaty obligations, and the legal protections generally afforded to visiting foreign leaders.
As the UN General Assembly approaches, the dispute has evolved into a broader confrontation over international justice, executive authority, and US foreign policy—placing Washington, New York City, and the ICC at the center of a closely watched global controversy.
